OVERVIEW
Welcome to Guide the Artist S.L. (“we”, “us”, “our”). Guide the Artist S.L. operates this online store and website, including all related content, features, products and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with our policies including the Privacy Policy and Refund Policy, set out the conditions under which you may access and use the Services. By using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
SECTION 1 – ACCESS AND ACCOUNTS
To use our Services, you must be at least the age of majority in your country of residence. You agree to provide accurate and complete information when using the Services, including for purchases. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
SECTION 2 – PRODUCTS
Our store offers both print-on-demand products (produced and shipped by our partners) and, in the future, original artworks and unique pieces sold directly by us. We aim to describe and present all items as accurately as possible, but we cannot guarantee that images (e.g. colors, scale) displayed on your device will exactly reflect the actual product.
We may discontinue products, update descriptions, or limit quantities at any time.
All prints include a digitally reproduced signature of the artist. Only original artworks and any Special Edition prints explicitly marked as hand-signed carry the artist’s authentic handwritten signature.
SECTION 3 – ORDERS
Placing an order constitutes an offer to purchase. Orders are accepted once we confirm them and process payment. We reserve the right to refuse or cancel orders for any reason, including suspected fraud, error, or unavailability.
Your purchases are subject to our Refund Policy. Unless explicitly authorized, products purchased are for personal use only and not for commercial resale.
SECTION 4 – PRICES AND BILLING
All prices are shown in the currency stated on the website at checkout. Prices may exclude applicable taxes, customs duties, and shipping fees, which will be calculated and displayed at checkout.
You agree to provide accurate and up-to-date payment details and authorize us to charge the applicable amounts for your order.
SECTION 5 – SHIPPING AND DELIVERY
Print-on-demand products are shipped directly by our production partners. Delivery times are estimates only and may vary depending on destination, customs clearance, and other factors beyond our control. Risk of loss passes to you once the product is transferred to the carrier.
Original artworks (when available) may be shipped directly from Guide the Artist S.L. under specific terms communicated at the time of sale.
SECTION 6 – INTELLECTUAL PROPERTY
All text, images, logos, artwork, and designs on our Services are the property of Guide the Artist S.L. or our licensors and are protected under applicable intellectual property laws. You may not reproduce, copy, or exploit our content without prior written consent.
SECTION 7 – THIRD-PARTY SERVICES
Certain services (including print-on-demand fulfillment and payment processing) are provided by third parties. These are beyond our control and provided “as is”. We are not liable for any issues arising from third-party services.
SECTION 8 – RETURNS AND REFUNDS
Returns and cancellations are governed by our Refund Policy. Customers in the European Union have the right to withdraw from purchases within 14 days, except for items excluded under applicable law (e.g. custom-made products).
SECTION 9 – LIMITATION OF LIABILITY
To the maximum extent permitted by law, Guide the Artist S.L. shall not be liable for indirect, incidental, or consequential damages, including loss of profits or data, arising from use of the Services or products purchased.
SECTION 10 – GOVERNING LAW
These Terms are governed by the laws of Spain and the European Union. Any disputes shall be submitted to the courts of the jurisdiction where Guide the Artist S.L. has its registered office.
SECTION 11 – CHANGES TO TERMS
We may update these Terms from time to time. Updated Terms will be published on this website, and continued use of the Services constitutes acceptance.
